    History of Lake Content
    In 1889, E.F. Tatums of Chicago went north looking for a completely unpopulated spot where they could get away from it all. They left the train at Tomahawk, bought a canoe and paddled up the Wisconsin River and took side trips into many lakes along the way. Then, gliding through a passage made by the Indians, they came upon a small lake which so impressed Mrs. Tatum that she remarked, This is the place, here we shall be content and so the lake was named.

    PROPERTY LOCATION:
    The auction tracts are located north of Hwy 70 along the east bank of Lake Content. To view the property travel west of St. Germain on Hwy 70 approximately 1/2 mile to the Awassa Nature Preserve and Hiking Trail entrance on the north side of the highway. The entrance to the parking area is located just west of the St. Germain elementary school entrance. From the parking area follow the signs through the Nature Preserve to view this one of a kind lakefront property!

    PROPERTY DESCRIPTION:
    INSPECTION DATES
    We invite you to meet with a Westchester representative during the above times at the Rustic Manor Motor Lodge to discuss any questions regarding the property or auction process. Boat tours will also be available during the above dates and times. Please stop by the Rustic Manor to register and also get directions to the boat tour loading area.
  • Access to Tracts 1-4 will be via permanent easement roadway from Highway 70. The roadway will be constructed according to minimum town standards following the sale.
  • Each tract will be sold subject to restrictive covenants determined by the seller. Please contact the auction company for detailed information regarding these covenants.
  • Each tract will be granted one dock placement.
  • Tract 5 will be provided access directly off of Hwy 70 via a shared driveway with the adjoining landowner.

  • AUCTION TERMS & CONDITIONS:

    PROCEDURE: The property will be offered in 5 individual tracts or in combinations. The property will be sold in the manner resulting in the highest total sale price.
    BID PROCESS: Tracts 1-5 will be offered Choice until individual tracts have been entered with a high bid. Tracts will also be offered in any combination. Individual tracts and combinations may compete. All individual tracts and combinations bids will remain open until the conclusion of the auction per the Auctioneer's bidding guidelines.
    DOWN PAYMENT: A 10% down payment of the contract purchase price will be due immediately after being declared the buyer. The down payment may be paid in the form of a personal check, business check, or cashier's check. The balance of the contract purchase price is due in cash at closing within 60 days. BIDDING IS NOT CONDITIONAL ON FINANCING.
    BUYER'S FEE: A ten percent (10%) Buyer's fee will be added to the final bid price to arrive at the total contract purchase price paid by the purchaser.
    ACCEPTANCE OF BID PRICES: All successful bidders will sign a purchase agreement at the auction site immediately following the close of bidding. Any and all final bids are subject to approval or disapproval by the Seller which shall occur at the auction on auction day, and shall be at seller's sole discretion.
    BUYER BROKER PARTICIPATION: A commission will be paid to any properly licensed Buyer Broker who registers a successful buyer according to the Broker Participation Guidelines. Broker Registration Forms are available from the Auction Information Office. Forms must be completed and returned no later than 48 hours prior to the auction.
    POSSESSION AND CLOSING: Possession of the Property shall be given at closing which shall occur as soon as possible after applicable closing documents have been completed. Anticipated closing date is on or before December 15, 2008.
    TITLE: Seller shall provide an Owner's Policy of Title Insurance in the amount of the purchase price, and shall execute a proper deed conveying the real estate to the buyer(s).
    REAL ESTATE TAXES AND ASSESSMENTS: The 2008 calendar year taxes payable in 2009 shall be prorated to the date of closing. Seller shall credit Buyer(s) at closing for said taxes based on the most recent ascertainable tax figures. Buyer will be responsible for all taxes and assessments thereafter.
    EASEMENTS: Sale of said property is subject to any and all easements and other matters of record.
    SURVEY: AT THE SELLER'S OPTION, the seller shall provide a new survey where there is no existing legal description. Any need for a new survey shall be determined solely by the seller. The seller will pay 100% of the cost if a survey is needed. The type of survey performed shall be at the seller's option and sufficient for providing title insurance.
    MINERAL RIGHTS: The sale of the property shall include all mineral rights owned by the Seller, if any.
    AGENCY: Westchester Auctions, LLC and its representatives are Exclusive Agents of the seller.
